This Privacy Policy governs Onsights Inc (“Onsights,” “we,” “our,” or “us,” as appropriate) collection, use, and disclosure of the personal information of the users of our website and services (collectively “Users” and individually a “User,” or “you,” as appropriate) and explains how we use and share this information. “Services” refers to our website (onsights.io), platform, and other ancillary services and applications.

We may change this Privacy Policy from time to time. If we make changes, we will provide notice by revising the date at the top of this policy and posting to our websites and platform, and in some cases, we may provide additional notice by sending an email notification to account holders. All changes to this Privacy Policy will be effective when posted, and your continued use of any Services after the posting will constitute your acceptance of, and agreement to be bound by, those changes.

The types of Personal Information we collect depends on how you interact with us and/or which products and services you use. We automatically collect certain Personal Information when you interact with us or use our Services. The types of information we collect automatically when you use our Services may include:

  • Log Information: We collect standard server logs in connection with your use of our Services, including the type of browser you use, access times, pages viewed, IP address and the web page you visited before navigating to our websites.
  • Device Information: We collect information about the computer or mobile device you use to access our Services, including the hardware model, operating system and version, unique device identifiers and mobile network information.

You will be given a reasonable opportunity to opt-out of any such additional purposes.

There is no contractual or statutory obligation for you to provide Personal Information. If you do not provide Personal Information, we will not be able to provide certain products and services to you.

Legal Basis for Processing

If you are an EU resident, we process your Personal Information only when we have valid legal grounds, such as when:

  • You consent to processing of your Personal Information. When you consent, you can change your mind at any time.
  • The processing is necessary for us to provide you with the products and services you request, such as when you register for an account or interact with our services, or to respond to your inquiries.
  • We have a legal obligation to process your Personal Information, such as to comply with applicable tax and other government regulations or to comply with a court order or binding law enforcement request.
  • To protect your vital interests, or those of others, such as protecting the safety of users.
  • We have a legitimate interest in carrying out the processing activity. For example:
    • To analyze and improve the safety and security of the services. This includes implementing and enhancing security measures and protections and protecting against fraud, spam, and abuse, or

Onsights may disclose your Personal Information for the purposes described below:

  • With vendors that perform services on our behalf (excluding mobile opt-in data and consent);
  • In response to a request for information if we believe disclosure is in accordance with or required by, any applicable law, regulation or legal process;
  • In response to lawful requests by public authorities, including to meet national security or law enforcement requirements;
  • If we believe your actions are inconsistent with our user agreements or policies, or to protect the rights, property and safety of Onsights or others (including to prevent actual or potential fraud);
  • In connection with, or during negotiations of, any merger, sale of company assets, financing or acquisition of all or a portion of our business by another company;
  • Between and among Onsights and its current and future parents, affiliates, subsidiaries and other companies under common control and ownership;
  • With your consent or at your direction. We may also share aggregated or de-identified information, which cannot reasonably be used to identify you; or
  • With other Onsights users that are associated with the same customer or subscriber account.

We are headquartered in the United States and the information we collect is governed by U.S. law. By accessing or using our Services or otherwise providing information to us, you consent to the processing and transfer of information in and to the U.S. and other countries, where you may not have the same rights as you do under local law. In certain circumstances, foreign courts, law enforcement agencies or regulatory agencies may be entitled to access your Personal Information. We apply the same security safeguards regardless of where data is stored, including encryption at rest and in transit, access controls, and regular security assessments.

If you are an EU resident, your personal information may be transferred or disclosed to service providers located outside the EU, consistent with applicable law. As such, we (i) rely on adequacy decisions of the European Commission or (ii) enter into the European Commission’s Standard Contractual Clauses as issued on 4 June 2021.

Children’s Privacy

Onsights’ products and services are not intended for children under the age of 18. We do not target our products and services to children under 18.

Depending on where you reside, you have the right to (1) request to know more about the categories and specific pieces of Personal Information we collect, use, share, and disclose, (2) withdraw consent you may have previously given; (3) request deletion of your Personal Information, (4) opt out of any sharing of your Personal Information that may be occurring, (5) request access to your Personal Information; (6) request correction of inaccurate Personal Information, and (7) not be discriminated against for exercising these rights.

If you are an EU resident, you also have the right to (8) to obtain a machine-readable copy of your Personal Information to you or an external party of your choice, (9) to restrict the processing of your Personal Information, (10) to object to our processing of your Personal Information for direct marketing purposes, and (11) to lodge a complaint with a EU data protection authority.
